Terms of Service

Northlake Smoke Shop sells age-restricted products including, without limitation, electronic cigarettes and vaping devices, tobacco and tobacco-derived products, hookah and shisha, kratom, hemp-derived cannabinoid products (such as CBD, Delta-8, Delta-9, and THCA where lawful), nicotine pouches, cigars, and related accessories. Pursuant to federal law (21 U.S.C. § 387f(d)) and the Illinois Tobacco Products Tax Act and related state law, you must be at least twenty-one (21) years of ageto access this website, enter our store, or purchase any product from us.

By using the Services, you represent and warrant that you are 21 years of age or older, that you will provide a valid government-issued photo ID upon request (in store or at delivery), and that you will not purchase or attempt to purchase any product on behalf of a minor. We reserve the right to refuse service to anyone for any lawful reason, including suspected underage purchase or resale.

The Services are intended for residents of, and visitors to, the State of Illinois, and specifically the western and northwest Chicago suburbs we serve. We do not ship age-restricted products outside of areas where applicable law permits such sales. You are responsible for ensuring that your purchase and use of any product complies with the laws of your jurisdiction.

Product descriptions, photographs, pricing, and availability are subject to change without notice. We make reasonable efforts to display accurate information, but we do not warrant that product descriptions or other content on the Services are accurate, complete, current, or error-free. In the event of a pricing or availability error, we reserve the right to cancel any order, even after an order confirmation has been issued.

Products containing nicotine, tobacco, kratom, or hemp-derived cannabinoids carry inherent health risks. These products are not intended for use by minors, pregnant or nursing women, or individuals with heart conditions, high blood pressure, diabetes, or other medical conditions. Statements regarding hemp- and kratom-derived products have not been evaluated by the U.S. Food and Drug Administration and are not intended to diagnose, treat, cure, or prevent any disease.

Online orders are fulfilled through third-party platforms, including Saucey, which handle payment processing, age verification at delivery, and final delivery to you. Your order is also subject to the third party’s terms and privacy policy. We are not responsible for delays, errors, or losses caused by third-party platforms or carriers, except as required by law.

All sales are final once an order has been age-verified and dispatched, except as expressly provided in our Returns & Refunds policy below. Applicable Illinois and Cook County sales, excise, and tobacco taxes will be added at checkout where required.

Due to the nature of the products we sell and applicable health and safety laws, all sales are final. We do not accept returns or exchanges on consumable products, including but not limited to vapes, e-liquid, kratom, hemp products, hookah tobacco, cigars, or any item with a broken manufacturer seal. If you receive a defective device under manufacturer warranty, contact us within seventy-two (72) hours of receipt at yazan.salama@yahoo.com or +1 (708) 223-5968 and we will assist you in filing a manufacturer warranty claim.

When using the Services, you agree not to: (a) misrepresent your age or identity; (b) use the Services for any unlawful purpose, including resale to minors; (c) interfere with the operation of the Services or attempt to gain unauthorized access to any portion of the Services or related systems; (d) upload or transmit viruses or malicious code; or (e) scrape, copy, or republish content from the website without our prior written consent.

The Services and all content on them — including the Northlake Smoke Shop name, logo, text, graphics, images, audio, video, and software — are owned by or licensed to us and are protected by United States and international copyright, trademark, and other intellectual property laws. You may not reproduce, modify, distribute, or create derivative works from any portion of the Services without our prior written permission, except as expressly permitted by these Terms.

The Services and all products are provided on an “AS IS” and “AS AVAILABLE” basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, secure, or free of errors, or that any product will meet your particular expectations.

To the fullest extent permitted by Illinois law, in no event shall Northlake Smoke Shop, its owners, officers, employees, affiliates, or suppliers be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the Services or any product purchased from us, even if we have been advised of the possibility of such damages. Our total liability for any claim arising out of or relating to these Terms or the Services shall not exceed the greater of the amount you paid to us for the product giving rise to the claim or one hundred U.S. dollars (US$100).

You agree to indemnify, defend, and hold harmless Northlake Smoke Shop and its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with: (a) your access to or use of the Services; (b) your violation of these Terms; or (c) your violation of any law or third-party right.

These Terms are governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict-of-laws principles. You agree that any dispute arising out of or relating to these Terms or the Services shall be brought exclusively in the state or federal courts located in Cook County, Illinois, and you consent to the personal jurisdiction of those courts.

We may update these Terms from time to time. The updated version will be indicated by a revised “Effective Date” at the top of this page and will be effective as soon as it is posted. Your continued use of the Services after the effective date constitutes your acceptance of the revised Terms.
